Supreme Court of Florida
Henry Lee Jones, Appellant v. State of Florida, Appellee — Pariente, J., Dissenting
March 2, 201742 Fla. L. Weekly Fed. S 257
Summary
Justice Pariente, dissenting, would have excluded evidence concerning two unrelated murders because the crimes lacked the unusual, distinctive similarities required to identify a common perpetrator. She also would have held that the extensive presentation of the collateral-crime evidence created unfair prejudice that substantially outweighed its probative value. Justice Quince, concurring in part and dissenting in part, agreed with affirmance of the conviction but would have remanded for resentencing because the sentencing error was not harmless.
