Summary

The court held that Ibar received ineffective assistance of counsel because trial counsel failed to present a facial-identification or forensic-anthropology expert to challenge the State’s central videotape identification. Given the poor-quality images, the absence of physical evidence, the importance of identification, and the other trial errors, the court concluded that the failure undermined confidence in the verdict and required a new trial. QUINCE, J., dissenting, agreed that counsel was deficient but would have found no prejudice and affirmed the denial of relief.
