Supreme Court of Florida
In Re: Amendments to the Florida Rules of Criminal Procedure - Corrected Opinion
January 21, 2016
Summary
The court adopted out-of-cycle amendments to several Florida Rules of Criminal Procedure and created a new model form for motions seeking jail credit. The amendments establish procedures for successive sentence-correction motions, revise postconviction and indigency forms, update capital postconviction records-production forms, and take effect January 1, 2016. Justice Canady, joined by Justice Polston, concurred in part and dissented in part because he would have authorized dismissal of additional successive motions presenting new or different grounds without good cause.
