Summary

The court held that the statute of limitations extension for offenses based on misconduct in office by a public officer or employee applies to public school teachers. It also held that the charged conduct was sufficiently connected to the teacher's duties because he used his position and authority to gain access to and influence the student victims, even though much of the conduct occurred off school grounds. Justice Pariente, dissenting and joined by Justice Perry, would have applied the rule of lenity and limited the statute to employees holding a legally defined public office.
