Summary

The Court retained the authorization for senior judges to serve as mediators but adopted two additional safeguards to reduce the risk that judicial status could create an appearance of impropriety or an advantage in obtaining mediation business. A senior judge may not mediate in a circuit where the judge is presiding, and entities associated with the judge must follow the same restrictions on advertising and promoting the judge's mediation services. The amendments apply across the Code of Judicial Conduct and the specified mediation and procedural rules, effective October 1, 2014.
