Supreme Court of Florida

Charles C. Peterson, Appellant v. State of Florida, Appellee; Charles C. Peterson, Petitioner, v. Michael D. Crews…

June 26, 2014154 So. 3d 275

Summary

The court affirmed the denial of Peterson's postconviction motion and denied his habeas petition. It held that Peterson failed to establish deficient performance and prejudice concerning jury selection, eyewitness-identification litigation, or cumulative error, and that although appellate counsel made a deficient factual misstatement about collateral convictions, the error did not undermine confidence in the appellate result. Justice Pariente, joined by Justice Quince, concurred in the judgment but argued that eyewitness-identification expert testimony should generally be admissible on a case-by-case basis.
