June 23, 201136 Fla. L. Weekly Supp. 305
Summary
The Supreme Court of Florida adopted amendments to Florida Rules of Criminal Procedure 3.850 and 3.851 and Florida Rules of Appellate Procedure 9.141 and 9.142 concerning postconviction motions, belated appeals, belated discretionary review, and ineffective-assistance claims. The amendments revise time limits, filing requirements, appeal procedures, death-penalty review procedures, and sanctions for frivolous or malicious collateral proceedings, effective July 1, 2011. The Court relied on a joint committee report developed after its prior amendments and modified some proposals to clarify the organization and cross-referencing of the rules.
