Summary
The court held that the identity and authority of the person who warned a defendant to leave school property are essential elements of trespass under section 810.097(2), Florida Statutes. The State therefore had to prove that the warning came from the principal or a person expressly or impliedly designated by the principal. Because the State presented no evidence that the security guard had such authority, the court quashed the district court's decision and vacated the conviction.
