Supreme Court of Florida

Manuel Antonio Rodriguez, Appellant v. State of Florida, Appellee; Manuel Antonio Rodriguez, Petitioner, v. Walter…

May 6, 201035 Fla. L. Weekly Supp. 249

Summary

The court affirmed the denial of Rodriguez's postconviction motion and denied his habeas petition. It held that although the State improperly withheld letters bearing on a key witness's credibility, Rodriguez failed to establish material prejudice, and he likewise failed to prove actionable ineffective assistance, suppression of favorable evidence, or knowing presentation of false testimony concerning the other witnesses. The court also held that Rodriguez could not use appellate-counsel claims to relitigate issues already rejected on direct appeal.
