Summary

The Court held that a trial court may set a juvenile restitution payment schedule to begin on a date certain even when the juvenile is unemployed, so long as the amount is based on what the juvenile and parent or guardian could reasonably be expected to pay or make upon suitable employment. The Court approved the Second District's decision and disapproved the conflicting decision to the extent it required restitution payments to commence only after the juvenile obtained employment. In any later enforcement proceeding, the juvenile's actual ability to pay and reasonable efforts to obtain employment remain relevant.
