Summary
The court adopted, with minor modifications, amendments requiring verification of residential mortgage foreclosure complaints and creating standardized forms for diligent-search affidavits and motions to cancel and reschedule foreclosure sales. It also adopted amendments to the final judgment of foreclosure form addressing statutory requirements, electronic sales, distribution of proceeds, redemption, surviving liens, possession, and privacy concerns. The amendments became effective immediately, subject to a sixty-day comment period for the amendments to the final judgment form that had not previously been published for comment. Canady, J., joined by Polston, J., concurred in part and dissented from adoption of the form governing cancellation and rescheduling of foreclosure sales.
