Summary

The Court held that the probationary portions of Massengill’s sentences for third-degree burglary and theft of a firearm exceeded the statutory one-year limit for nonviolent, non-drug-related offenses and remanded those sentences for correction. It otherwise found the appeal wholly without merit after independently reviewing the record and affirmed the remaining judgment. The Court also concluded that the motion to withdraw was moot.
