Summary

The Court held that the Superior Court incorrectly treated Dale’s motion as time-barred because a motion seeking reduction of partial confinement may be filed at any time. The Court nevertheless affirmed because the motion was Dale’s second Rule 35(b) motion and therefore was barred as repetitive. The Court also applied the abuse-of-discretion standard to the denial of sentence modification.
