Supreme Court of Delaware

Jackson v. State

August 18, 2025

Summary

The Court affirmed the denial of Jackson’s motion to correct an illegal sentence. It held that the rule requiring a jury finding for a prior-conviction-based sentence enhancement was inapplicable because Jackson’s sentence was not enhanced based on prior convictions, and that deviation from the SENTAC Guidelines did not render the sentence illegal because the guidelines are voluntary and nonbinding. No separate opinions were filed.
