Terreros v. State

Summary

The Court held that the warrant authorizing the search of Terreros's cell phone was a general warrant because probable cause supported only a limited search of internet history, while the warrant authorized searches of nearly every major category of digital data and contained no temporal limitation. Because all evidence obtained under a general warrant must be suppressed and the State failed to establish harmlessness beyond a reasonable doubt, the Court reversed Terreros's convictions and remanded. The Court also remanded Terreros's inconsistent-verdicts claim for consideration under the Delaware Constitution because the State and Superior Court had not addressed that argument.
