Shaw v. State

Summary

The Court affirmed the denial of Shaw’s motion to correct an illegal sentence. It held that Rule 35(a) cannot be used to challenge alleged errors preceding a conviction, and that Shaw’s no-contest plea waived such challenges; alternatively, any waiver of preliminary-hearing or indictment rights caused no harm because the waiver was withdrawn and a valid grand-jury indictment followed. The Court also concluded that Shaw’s sentence was legal in all respects.
