Supreme Court of Delaware
Johnson v. State
July 23, 2024
Summary
The Supreme Court of Delaware affirmed the Superior Court’s summary dismissal of Jonathan Johnson’s fourth motion for postconviction relief. The Court rejected Johnson’s newly raised contention that his sentence was illegal for lacking a transitional probation period and concluded that his repeated, untimely, and frivolous filings abused the judicial process. The Court therefore imposed a filing restriction requiring preapproval and payment of the filing fee or a qualifying in forma pauperis motion for future filings concerning these convictions and sentence.
