Summary

The Supreme Court of Delaware affirmed Hale’s assault-in-the-second-degree conviction. Although the trial court omitted both a general-unanimity instruction and a specific-unanimity instruction, the omissions did not constitute plain error because the record showed the jury understood its verdict had to be unanimous, the assault involved a single incident, and the evidence supporting both liability theories was highly persuasive.
