Supreme Court of Delaware

Haas v. State

August 2, 2024

Summary

The Court affirmed Haas’s sentence after concluding that the Superior Court did not abuse its discretion by considering the challenged mitigating and aggravating factors or by imposing a sentence above the presumptive guidelines. Although the Court assumed that applying the “offense against a child” aggravator may have been erroneous, it held that any error was harmless because four other aggravating factors supported the sentence and the sentence did not exceed the statutory maximum.
