Elder v. State

Summary

The Supreme Court of Delaware affirmed the denial of David Elder’s first motion for postconviction relief. It held that Elder failed to establish either deficient performance or prejudice under his ineffective-assistance claims concerning judicial bias, prosecutorial misconduct, witness cross-examination, the DNA warrant, the residential search, and cumulative error. The court also found that the Superior Court independently reviewed the claims and properly considered Elder’s pro se reply.
