Supreme Court of Delaware
Cross v. Dscyf/dfs
October 31, 2024
Summary
The Supreme Court affirmed the Family Court’s termination of Tessa Cross’s parental rights after concluding that the record supported the finding that she failed to plan adequately for her child’s physical, mental, and emotional needs. The Court also found sufficient evidence that the statutory additional condition and the child’s best interests supported termination by clear and convincing evidence. Mother’s counsel filed a no-merit brief and motion to withdraw, and the Court found no arguably appealable issue.
