Summary

The Supreme Court affirmed the denial of Thomas Ott's motion to modify the Level IV work-release portion of his sentence. Although the ninety-day limitation in Rule 35(b) did not apply to a request concerning partial confinement, the motion was repetitive because Ott had previously filed multiple sentence-modification motions. The Superior Court therefore had authority to deny it on that ground.
