Supreme Court of Delaware
Odell v. Unemployment Insurance Appeal Board
December 15, 2023
Summary
The Court affirmed the Superior Court’s judgment upholding the Board’s determination that Odell owed $7,139 in overpaid unemployment benefits. Because Odell conceded that she was ineligible and did not dispute the calculations, Delaware law required repayment regardless of whether the overpayment resulted from her mistake, a Department error, or a computer-system problem. The Court also rejected her waiver, discovery, new-evidence, and disparate-treatment arguments, while noting that she might apply for a waiver under a subsequently enacted statute.
