Supreme Court of Delaware

Morris v. State

May 25, 2023

Summary

The Court affirmed the denial of Morris’s motion to correct an allegedly illegal sentence. It held that statutory forfeiture of good-time credits was not a sentencing term that had to be addressed during the guilty-plea colloquy, and that a predicate conviction need not be fully completed before it may support habitual-offender sentencing. The Court also noted that Morris’s four-month sentence was below the applicable statutory maximum and therefore legal.
