Supreme Court of Delaware

Martin v. State

October 9, 2023

Summary

The Court held that a timely postconviction motion filed while the defendant is in custody is not rendered moot by his later completion of the sentence if he pleads continuing collateral consequences from the conviction. Because Martin was unconditionally pardoned for his prior felony convictions and adequately identified legal burdens associated with his new felony convictions, the Court reversed the dismissal and remanded for proceedings on the merits. No separate opinions were filed.
