Supreme Court of Delaware

Holmes v. Grant

April 3, 2023

Summary

The Supreme Court of Delaware affirmed the Family Court’s order modifying the youngest child’s primary residential placement, school enrollment address, and contact schedule. The Court held that the Family Court acted within its broad discretion, that later-occurring events must first be presented to the Family Court, and that the statutory challenge to the modified schedule was not preserved. The Court also concluded that the schedule did not, as a matter of law, fail to provide frequent and meaningful contact.
