Supreme Court of Delaware
Hofmann v. State
June 27, 2023
Summary
The Court affirmed Hofmann’s DUI-related convictions, holding that the State laid an adequate foundation for admitting the blood-alcohol test results. Although the arresting officer could not recall the precise sequence of two blood-draw steps, his testimony and the laboratory director’s testimony provided a reasonable basis to conclude that the manufacturer’s procedures were followed. The Court also upheld denial of Hofmann’s judgment-of-acquittal motion because it depended on the blood-test results being excluded.
