Supreme Court of Delaware

Slaughter v. State

January 25, 2022

Summary

The Court affirmed the denial of Slaughter’s postconviction-relief motion. It held that his challenge to the voluntariness of his waiver under the Interstate Agreement on Detainers was procedurally barred, but that his ineffective-assistance claims were not procedurally barred because such claims cannot be raised on direct appeal and therefore remain available in postconviction proceedings. The Court nevertheless rejected the ineffective-assistance claims on the merits, finding no deficient performance in failing to appeal after a guilty plea that waived appeal rights and no prejudice from counsel’s failure to seek an earlier trial date.
