Summary

The Court affirmed the denial of Richmond’s motion to correct an illegal sentence. It held that his challenge to the sentencing judge’s failure to explain a departure from the SENTAC guidelines alleged an illegally imposed sentence, which had to be raised within ninety days absent extraordinary circumstances; Richmond identified none. The Court also held that exceeding the SENTAC guidelines, by itself, does not make a sentence illegal.
