Summary

The Court affirmed the denial of Ramos’s motion to correct an illegal sentence under Rule 35(a). Although the Superior Court appears to have treated the motion as one for sentence modification, the Court held that the motion independently failed because the violation-of-probation sentence did not exceed the remaining Level V time authorized by statute and did not become illegal merely because it exceeded the SENTAC guidelines.
