Supreme Court of Delaware
Morrison v. State
March 16, 2022
Summary
The Court affirmed the denial of Morrison’s postconviction motion after concluding that his ineffective-assistance claims failed for lack of prejudice, his challenges to the State’s evidence were waived by his voluntary guilty plea, and his claim concerning the Superior Court’s handling of plea withdrawal was procedurally barred. The Court also held that the circumstances did not warrant a presumption of prejudice based on a constructive denial of counsel. The Court found the appeal wholly without merit under the applicable withdrawal procedure.
