Summary

The Supreme Court of Delaware reversed the Court of Chancery’s dismissal of Kroll’s complaint because the dismissal rested on the erroneous conclusion that the CBA grievance procedure provided an adequate legal remedy. Although the City urged affirmance on alternative grounds, the Supreme Court declined to address those grounds because the Court of Chancery had not considered them in the first instance.
