Summary

The Court held that GEICO's automated rules for evaluating PIP claims did not establish breach of the insurance contract or bad-faith breach because the claimants did not prove nonpayment of reasonable and necessary expenses or the absence of reasonable justification. The Court also held that courts have authority to review whether an insurer's claims-processing practices comply with the PIP statute, but reversed the declaratory judgment because the claimants disavowed proving that their expenses were reasonable and necessary. The judgment was therefore affirmed in part and reversed in part.
