Supreme Court of Delaware

Garnett v. State

May 23, 2022

Summary

The Court affirmed the denial of Garnett’s motion to correct an illegal sentence. Although Garnett was sentenced under an incorrect version of the habitual-offender statute, the applicable version authorized habitual-offender sentencing because he had three prior felony convictions, and the incorrect and correct versions imposed the same sentencing range and minimum sentence. The Court therefore held that the sentence was not illegal.
