Supreme Court of Delaware

Delaware Association of Alternative Energy Providers, Inc. v. Chesapeake Utilities Corporation

March 10, 2022

Summary

The Court affirmed dismissal of the Association’s challenge to a settlement approved by the Public Service Commission because the Association neither intervened in the underlying proceeding nor otherwise became a party with standing to contest the settlement. The Court also held that the separate complaint became moot when the Commission approved the settlement before the challenge was resolved. Because standing and mootness were dispositive, the Court did not address the remaining claims.
