Supreme Court of Delaware

Thomas v. State

October 7, 2021

Summary

The Court affirmed the denial of Thomas’s motion to modify his sentence. It held that Thomas was ineligible for juvenile-offender sentence modification because he was nineteen when he committed the offense, was not sentenced to more than twenty years, and had not served twenty years. The Court also held that the Superior Court correctly concluded that it could not reduce the fifteen-year mandatory minimum sentence. Thomas’s additional arguments were waived because he did not raise them in his opening brief.
