Summary

The Court affirmed the Superior Court’s denial of Perry’s motion to modify or review his sentence. It held that the motion was repetitive and untimely because it was filed more than ninety days after sentence was imposed, and that Perry failed to establish extraordinary circumstances warranting review. The Court also concluded that successful completion of a Level V program could reasonably be treated as an essential component of Perry’s violation-of-probation sentence.
