Summary

The Court held that Juliano's warrantless arrest was unsupported by probable cause because the officers relied solely on an inadequately described marijuana odor, without other evidence showing that she had committed an arrestable crime. Because the searches and Juliano's subsequent admissions followed the unlawful arrest, the resulting evidence was fruit of the poisonous tree and should have been suppressed. The Court reversed the Family Court's judgment and vacated Juliano's adjudication of delinquency.
