Supreme Court of Delaware

Harris v. DFS

April 20, 2021

Summary

The Supreme Court held that the Family Court incorrectly interpreted Section 1114 to prohibit standard guardianship after termination of parental rights. It nevertheless affirmed denial of Harris’s guardianship petitions because they failed to plead facts showing that the Children were dependent, neglected, or abused, and the Children had subsequently been adopted. The Court also concluded that the adoption orders could not be attacked through the guardianship appeal.
