Summary
The Court affirmed the denial of Wehde’s petition for sentence modification under the habitual-offender statute. Although the Superior Court misstated which version of the statute applied, it correctly recognized the applicable minimum sentence and properly considered Wehde’s criminal history, prison conduct, risk of reoffending, and responsibility for his crimes. The Court also held that the Public Defender’s Office was not disqualified from representing Wehde in the sentence-modification proceedings.
