Supreme Court of Delaware

IMO Webb

March 26, 2020

Summary

The Court dismissed Webb’s petition for a writ of mandamus seeking dismissal of pending criminal charges and immediate release from prison. Webb failed to show that the Superior Court had arbitrarily refused to perform a duty or that he lacked an adequate remedy through the trial proceedings and appellate process. The Court also held that mandamus could not be used to control trial scheduling, compel a particular ruling, or substitute for an appeal.
