Supreme Court of Delaware

Grimes v. State

July 21, 2020

Summary

The Court affirmed the denial of Grimes’s first motion for postconviction relief. It held that his challenges to the indictment amendment were procedurally barred because he had not raised them earlier, and that his repackaged double-jeopardy claim was barred because it had already been adjudicated. The Court also held that changing the named robbery victim did not charge a different offense, prejudice his substantial rights, or divest the Superior Court of jurisdiction.
