Supreme Court of Delaware

Gatewood v. State

July 9, 2020

Summary

The Court affirmed the denial of Gatewood’s motion to correct an illegal sentence. It held that the classification of a prior offense as a violent felony is determined by the version of the violent-felony statute in effect when the current sentence-enhancing offense was committed, and therefore Gatewood’s handgun-related 2009 CCDW conviction qualified under the statute in effect for his 2015 PFBPP offense.
