Summary

The Delaware Supreme Court affirmed the Superior Court’s VOP sentence after finding that Folks’s discharge from sex-offender treatment violated conditions of his conditional release and probation. The Court held that a VOP appeal could not be used to collaterally attack the legality of the original arrest or convictions, rejected Folks’s conclusory due-process and international-human-rights claims, and held that his “without prejudice” notation did not negate the treatment condition.
