Summary

The Supreme Court of Delaware affirmed the Family Court’s termination of the mother’s parental rights. The Court held that clear and convincing evidence supported both a statutory ground based on the mother’s failure to plan adequately for the child’s needs and the conclusion that termination served the child’s best interests, and it rejected each of the mother’s asserted errors. The Court also held that one evidentiary challenge was not preserved for appeal and that the Family Court acted within its discretion in declining to interview the young child.
