Summary

The Supreme Court of Delaware affirmed the denial of Anzara Brown’s motion to reopen the suppression hearing. Although the Superior Court improperly treated the motion as an untimely motion for reargument, the Supreme Court held that the motion lacked merit under Rule 60(b) because that rule cannot be used to collaterally attack a final criminal conviction and because Brown had already received a full and fair suppression hearing. No separate opinions were filed.
