The Court affirmed the denial of Booker’s first motion for postconviction relief. It held that Booker failed to establish ineffective assistance because the challenged trial decisions were objectively reasonable and, in any event, did not prejudice him; his unpreserved conspiracy-instruction claims were procedurally barred and meritless because conspiracy is not a lesser-included offense of the charged crimes.
