Supreme Court of Delaware

Baynard v. State

April 3, 2020

Summary

The Supreme Court of Delaware affirmed the denial of Baynard’s motion to modify his sentence under Superior Court Criminal Rule 35(b). Because the motion was repetitive, filed more than ninety days after sentencing, and was unsupported by extraordinary circumstances or a Department of Correction application, the Superior Court did not abuse its discretion. Baynard’s rehabilitation efforts and desire to enter a treatment program did not alter that conclusion.
