Supreme Court of Delaware
Tower v. Fowler
October 10, 2019
Summary
The Supreme Court affirmed the Family Court’s denial of John Tower’s petition to modify custody, request for increased visitation, and motion for judicial recusal. The Family Court properly found no credible evidence that continuing Fowler’s sole-custody and primary-residence arrangement would endanger the child, and it reasonably determined that increased visitation was not in the child’s best interests given Tower’s history and conduct. The Supreme Court also found that the Family Court judge was not biased and that the factual findings were supported by the record.
