Supreme Court of Delaware

Scott v. State

April 29, 2019

Summary

The Court affirmed Scott’s convictions, holding that the evidence was sufficient for a rational jury to find that he intended to commit attempted robbery. Although the State did not prove that the use of force was planned in advance, Scott knowingly participated in an attempted theft, carried a weapon, and reached for it during the attempted theft, permitting the jury to infer that force was used in the course of committing the theft.
